Samsung Electronics in the US can be Blocked by Apple Inc. (NASDAQ:AAPL)
Apple Inc. (NASDAQ:AAPL) is on the victorious side of a court ruling which will allow Apple to go after a sales ban on some of the products by Samsung Electronics Co., Ltd. (KRX:005930); these products violated on some features for smartphones. Apple claims that it has exclusivity to these features, which include technology such as multi-touch. The American Federal Circuit appeals court, however said that Apple can’t block Samsung products for violation of patented designs.
According to the court’s ruling Apple must be able to prove that the features for which Apple wants to purse the sales ban on Samsung products must be a factor in customers’ decision about which smartphone they want to buy. The court’s ruling allows Apple another opportunity to stop its leading rival’s sales in the smartphone market worth $279.9 billion. Apple has one more case lined up against a few latest models by Samsung that include Samsung Galaxy S III; the case goes to trial next year in March.
Last year, after a case went against Samsung, Apple was awarded compensation worth $1 billion by the Federal jury; however a portion of this damage has gone to a retrial in a California Federal Court. The $1 billion compensation won by Apple is not even equal to iPhone’s two weeks’ sales.
Apple wants Samsung to stop selling or change a few of its smartphones and tablets in the US. The lawsuit was filed by Apple back in 2011 (April) claiming that Samsung is replicating the innovative technology introduced by Apple Inc. (NASDAQ:AAPL).In response Samsung came with its patent claims, which has developed this issue into a full-fledged legal battle which covers four continents.
